Dallas Mavericks owner Mark Cuban was investigated for sexual assault in 2011

With AP Photos.The NBA says it is reviewing 2011 allegations of sexual assault against Dallas Mavericks owner Mark Cuban and the decision by prosecutors not to pursue the case.

'Cuban then pushed his hand down the back of her jeans and inside her underwear where he cupped his hand over her groin area and inserted the tip of his finger into her vagina'. They were described by an officer as showing Cuban, whose hands were not visible, appearing to "be stretching to reach his arm down" while standing beside the woman.

The woman told the Willamette Week in a recent interview she still stood by the charges.

Cuban, while being investigated by police for the alleged assault, expressed panic at the idea of being accused and uncertainty of how to defend himself.

Though originally presented to police in 2011, the accuser came forward this week, saying she did so because "What he did was wrong". The complainant has also consistently and repeatedly stated to police investigators she does not want to pursue this matter further.

A week later, the alleged victim filed a complaint with the local police, which led to an investigation.

Charges were never filed after the District Attorney determined there was insufficient evidence as no witnesses or physical evidence were found.

In February, Sports Illustrated published their story detailing alleged sexual misconduct by former Mavericks president Terdema Ussery as well as domestic violence by Mavs.com writer Earl K. Sneed.

"Cuban's response in 2011: "'Cause I always make a point to show my ring finger whenever I take pictures with girls. Cuban was inPportland during the time in question for a basketball game.

"Nothing is revealed in the photographs which demonstrates a sexual assault or even inappropriate physical contact", the prosecutor wrote.

"It was apparent he was very drunk", the woman's friend later told police.

The woman claimed Cuban reached inside her trousers and penetrated her vagina with his finger while they were taking a picture in a Portland nightclub.

Furthermore, they added, "There is no evidence to corroborate the complainant's statement and there is evidence contradicting the claim".
