Zarate, 45, was acquitted of murder and involuntary manslaughter charges, as well as assault with a deadly weapon.
The defense insisted, as per the Chronicle, that Garcia-Zarate, "who had a history of drug crimes but no record of violence, found the gun wrapped in a T-shirt or cloth under his seat on the pier just seconds before it discharged in his hands".
Zarate, a convicted felon who has been deported from the US five times, was accused of fatally shooting the 32-year-old Steinle in July 2015 while she was walking with her father and a friend in San Francisco.
Garcia Zarate, a Mexican man who was in the United States illegally, shot Steinle on a San Francisco pier in 2015.
"This man, or this animal, that shot that wonderful, that attractive woman in San Francisco, this guy was pushed back by Mexico", Donald Trump told CNN in July 2015 shortly after announcing his candidacy.
The semi-automatic handgun used to kill Steinle was stolen from a federal Bureau of Land Management ranger a week before the shooting. And even the prosecution agreed that there was no evidence linking Garcia Zarate to that robbery. Zarate had been in a San Francisco jail on charges of selling marijuana but was released three months before the incident and allowed to remain free under sanctuary city laws. "This tragedy could have been prevented if San Francisco had simply turned the alien over to ICE, as we requested, instead of releasing him back onto the streets". "I urge the leaders of the nation's communities to reflect on the outcome of this case and consider carefully the harm they are doing to their citizens by refusing to cooperate with federal law enforcement officers". In the aftermath of the shooting there was a lot of finger-pointing among local officials.

At the press conference, the accused players also apologized for their actions and said they did not exercise the proper judgment. UCLA athletic director Dan Guerrero confirmed Ball, Riley and Hill stole merchandise from three different stores, per Bonagura .
Zarate, of Mexico, had been deported several times and has previous convictions for re-entry after deportation. In reality, she was shot only once.
Trump also mentioned Steinle in his acceptance speech at the Republican National Convention after winning the Republican presidential nomination.
Trump signed an executive order to withhold funding from sanctuary cities, but a federal judge recently blocked it in a lawsuit from two California counties, San Francisco and Santa Clara.
Yet in aftermath of his sister's death, Brad Steinle spoke out against then-candidate Trump for "sensationalizing" her death.
The fatal bullet struck concrete about 12 feet away from the defendant and traveled another 78 feet to hit Kathryn Steinle. I've never heard a word from his campaign manager, I've never heard a word from him.
Despite the national political implications, the San Francisco jury was charged with a more discreet task of criminal culpability for Steinle's death. The Department of Justice will continue to ensure that all jurisdictions place the safety and security of their communities above the convenience of criminal aliens.
